Welcome to The Yesterday Times. These Terms of Service (“Terms”) govern your access to and use of the services, websites, and applications (the “Service”) provided by The Yesterday Times (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Nature of the Service — Novelty & Entertainment

The Yesterday Times is a novelty, entertainment, and keepsake product. It uses automated editorial systems to compose fictionalized, newspaper-styled pages inspired by a date you choose. The generated pages are creative recreations, not factual news reporting, journalism, or a historical record, and must not be relied upon for any factual, professional, financial, medical, legal, or other purpose.

The Yesterday Times is an independent product. It is not a newspaper and is not affiliated with, endorsed by, sponsored by, or connected to any real newspaper, publication, news organization, or media brand. All mastheads, publication names, mottos, datelines, prices, weather, and market tickers are fictional and generated for stylistic effect. Any resemblance to a real publication is coincidental.

2. Eligibility

You must be at least 18 years old to make purchases or hold an account. If you are a minor in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms. We do not knowingly provide the Service to, or collect data from, children in violation of applicable law.

3. Account Responsibilities

To access certain features, you may need to register an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Keep your login credentials secure and confidential.
  • Promptly notify us of any unauthorized use or security breaches of your account.

You are fully responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You shall not:

  • Generate, request, or distribute content that is defamatory, false and damaging to a real person, obscene, harassing, hateful, threatening, invasive of privacy, or otherwise unlawful or objectionable.
  • Create content about, or incorporating the name, likeness, image, or private information of, any real identifiable person without the rights and consents required to do so.
  • Use the Service to impersonate any person or entity, to create content that could deceive a reasonable person into believing it is genuine news, or to remove or obscure any disclaimer we apply to generated pages.
  • Infringe the intellectual property, trademark, publicity, or privacy rights of any third party, including by reproducing the trade dress or masthead of a real publication.
  • Attempt to disrupt, reverse-engineer, or breach the security of the Service, servers, or networks; or use automated bots or scripts to scrape data or systematically generate content.

5. User-Supplied Content & Personalization

Some features (such as personalized or gift editions) let you supply text, names, dates, facts, occasions, and photographs (“User Content”), including information about other people such as a gift recipient. You are solely responsible for your User Content. By submitting it, you represent and warrant that:

  • You own or have all necessary rights, licenses, and consents to submit it and to have it processed and printed as part of the Service.
  • You have obtained the consent of any identifiable living person whose name, likeness, photograph, or personal information you include.
  • Your User Content is accurate, not defamatory, and does not violate any law or any third party’s rights.

You retain ownership of your User Content. You grant us a limited, worldwide, royalty-free license to host, process, reproduce, and print it solely to operate the Service and fulfill your requests (including via our editorial, image, and print-fulfillment providers). We may remove any content or refuse any order that we believe, in our sole discretion, violates these Terms or applicable law.

6. Disclaimer of Generated Archive Content & Warranties

The Yesterday Times uses automated editorial systems to compose historical-style newspapers, layouts, and text based on user-selected dates and topics.

Generated archive content may contain factual inaccuracies, fabrications, anachronisms, or editorial errors, and may reference real events or people inaccurately. The Service and all generated content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

7. Intellectual Property

Except for public-domain facts, your User Content, and third-party photographs (which remain the property of their respective owners), all code, user interfaces, branding, layout templates, and designs of The Yesterday Times are the intellectual property of The Yesterday Times or its licensors. The legal status of copyright in fully automated text and imagery is unsettled in many jurisdictions, and we make no representation that you (or we) own any enforceable copyright in the automatically composed portions of a page.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access, download, share, and print the pages you generate for your personal, non-commercial use.

8. Payment Terms & Billing

We offer paid services, including digital newspaper unlocks, recurring premium subscriptions, and custom physical print editions.

  • Digital Unlocks: Permanently unlock digital access to a specific generated newspaper page.
  • Subscriptions: Grant recurring access to premium features. Subscriptions are billed in advance on a recurring interval (monthly/annually) and automatically renew until canceled.
  • Physical Prints: Customized orders to print and mail physical replicas of your generated newspapers.

Payments are processed by our third-party merchant-of-record providers (Dodo Payments / Paddle), who act as the seller of record for the transaction and handle billing and applicable taxes. By initiating a transaction, you authorize the processor to charge your designated payment method, and you agree to the processor’s terms. Refunds are governed by our refund terms.

9. Fulfillment of Physical Prints

Physical print orders are custom-manufactured on-demand and shipped through our global fulfillment partner, Gelato. Delivery times are estimates and may vary based on shipping destination, customs clearance, or carrier delays. You are responsible for providing a correct and complete shipping address. We are not liable for packages lost or undelivered due to inaccurate shipping information provided by you.

10. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless The Yesterday Times and our partners and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your User Content; (b) your use of the Service; (c) your violation of these Terms or any law; or (d) your violation of any rights of a third party, including any claim that content you created or requested is defamatory or infringes a person’s intellectual property, privacy, or publicity rights.

11. Limitation of Liability

To the maximum extent permitted by law, The Yesterday Times and our affiliates and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, arising from:

  • Your access to or use of (or inability to access or use) the Service.
  • Any inaccuracies, fabrications, or errors in generated archive content.
  • Any third-party conduct or content on the Service.
  • Any delays or issues related to shipping and custom print fulfillment.

To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Service shall not exceed the greater of (i) the amount you paid us for the Service in the three (3) months preceding the event giving rise to the claim, or (ii) USD 50. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

12. Termination

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Material changes will take effect when posted, and your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

14. Governing Law & Dispute Resolution

These Terms are governed by the applicable laws and consumer protections that cannot be waived in your jurisdiction. We will attempt to resolve any dispute informally first through the contact details below.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
